How can we fight spamming on a legal level?

  Modified law (LTC)As a result of a change to the federal law against unfair competition, customers are better protected from unfair mass advertising (spam) sent using telecommunications. Senders of such mass advertising must now obtain the consent of customers before transmission (the “opt-in” model). Telecommunications service providers are obliged to combat unfair mass advertising.

  In light of the Article 8 of the law on the protection of personal information (in French), you have the right to demand from a listholder what personal data he possesses that concerns you.

Until the day that rigorous regulations are in place to stanch the flow of unsolicited e-mail by dubious sources, the most efficient means of avoiding spam is undoubtedly through a mail filter that places all e-mail resembling spam in quarantine.
